Football Association of Malawi’s (Fam) Disciplinary Committee has nullified the election that Beach Soccer Association (BSA) held in Mangochi District.
The poll took place in August this year following Fam’s order based on the need for executive committee members to renew their respective mandates after expiry of their terms of office.
This was after the office bearers had tried in vain to convince Fam that they had renewed their mandates through a meeting that had taken place in 2018.
The disciplinary committee met recently following Fam’s complaint against some BSA members who had taken the matter to a court of law.
In its ruling, the committee said it nullified the elections on the basis of several irregularities.
“An election can be valid only when there is a legitimate electorate and, in this case, legitimate delegates to the Annual General Assembly. Legitimate delegates to the Annual General Meeting must be determined through elections or appointment of office bearers at the affiliate level first.
“Fam failed to provide the legitimacy of the delegates who participated in the elections. In fact, Fam conceded that it was an error on its part. Even if the legitimacy had been proved, having found the Fam directive to be null and void, the actions, as stated already, consequent to the directive must be illegal and therefore null and void. It is therefore this committee’s ruling that the elections conducted by Fam are null and void,” reads part of the ruling.
Fam was also faulted for usurping judicial organs when it directed that the elections should take place.
The committee also noted that BSA had no executive committee from 2018 to date since the process of ushering in the Kondwani Gondwe-led committee was also not done properly.
“As such, in the absence of the full quorum being met, there was no General Assembly and deliberations of that meeting are null and void including the business of the day pertaining to re-appointment of the BSA Committee. Since the appointment is found to be null and void, it follows that BSA has had no Executive Committee from 2018 to date,” the ruling reads.
The polls saw Gift Chimbalanga elected as chairperson after defeating Mike Bwanali 14 votes against one.
Former Nyasa Big Bullets and Silver Strikers defender, Panganeni Ndovi, was elected vice chairperson unopposed with Wakisa Mwambetania also having no contender for the post of general secretary.
Jayne Jella and Force Ngwira were elected vice General Secretary and Treasurer unopposed, respectively.
William Kumilambe was voted Organising Secretary after defeating Wanangwa Kapapa 12- 3. Andy Khunga, Edwin Mtachi and Samson Malipa were elected committee members.
