Blue Night case returns


The case in which rights activist Gift Trapence and others are challenging the sale of Blantyre City Council’s house to former governing Democratic Progressive Party (DPP) and some statutory corporations’ donation of K13.5 million to the DPP during its Blue Night fundraising dinner will return to the court on October 9 this year.

Mzuzu City Council, Lilongwe City Council and Lilongwe Water Board allegedly donated the money towards the DPP’s Blue Night fundraising initiative which former president Peter Mutharika and former First Lady Gertrude attended.

A notice of mediation which The Daily Times has seen calls the two sides to a negotiation table.


“Take notice that the mediation in the matter herein will be on 09th October, 2020 at 10:00 in the forenoon before Honourable Justice Masoamphambe in chambers,” reads the notice.

The applicants’ lawyer Wesley Mwafulirwa said the mediation is mandatory in the current circumstances.

“Before any trial of this nature, there is need for parties to go for mediation. We want all the money which might have been lost but if we don’t reach a consensus we will go for trail,” he said.


The notice of the mediation has also been copied to Attorney General (AG) Chikosa Silungwe but the AG said he was yet to see it.

The DPP and the statutory corporations have been challenging commencement of the matter saying the rights activists do not have sufficient interest.

The claimants fought all the way to the Supreme Court of Appeal to have the matter dismissed but Justice Dunstain Mwaungulu threw out the application, saying the rights activist had sufficient interest to in the matter.

Before the matter went to the Supreme Court of Appeal, Justice Zione Ntaba of the High Court directed that the matter be taken for mediation by Justice Redson Kapindu of the High Court at Zomba Registry.

In a separate interview, Trapence said he is looking forward for both the mediation and the trial.

“Malawians want this money and the house recovered and that is what we are fighting for,” he said.
