Modecai Msisha concludes cross-examining Ben Phiri

Lawyer representing Malawi Congress Party (MCP)s Senior Counsel, Modecai Msisha, in the ongoing presidential elections case at the Constitutional Court in Lilongwe Monday concluded cross-examining Democratic Progressive Party (DPP) candidate Peter Mutharika’s witness, Ben Phiri.

Among others, Msisha grilled Phiri on alterations and erasures on results sheets during the May 21 elections.

Msisha argued that the overwhelming incidences of result alterations were indication enough that the elections were marred by many irregularities.

“We wanted to establish that the sworn statements of the witness were not based on facts but rather his understanding of what the position of the Malawi Electoral Commission was.

“We think there was some distortion to positions to fit the whole evidence into something supporting the conclusion that there was nothing wrong in the process,” Msisha said.

After Msisha finished cross-examining Phiri, lawyer for DPP Mutharika, Frank Mbeta, then started re-examinimg Phiri.

Mbeta is expected to conclude re-examining Phiri today.

DPP second witness, Bob Chimkango, is expected to take to the witness box after Phiri.

MCP President, Lazarus Chakwera, and UTM President, Saulos Chilima, want the results of the elections nullified on the groung that the polls were marred by many irregularities.

The court, which started hearing the case on August 8, is expected to conclude the hearing on December 6.
