Norman Chisale sues Attorney General over unfair detention

Former president Peter Mutharika’s security aide, Norman Chisale, has sued the Attorney General for unlawful custody. Chisale’s lawyer, Chancy Gondwe, said they filed the suit at the Supreme Court of Appeal on Thursday.

Chisale is on remand following his arrest on a murder charge in connection with the death of former Anti Corruption Bureau (ACB) Director of Corporate Services Issa Njauju in 2016.

“We filed an application at the Supreme Court to release our client who is in illegal custody. One can only be on remand pending committal for 30 days, according to the law,” Gondwe said.

Supreme Court judge Lovemore Chikopa has since adjourned the hearing to a later date.

Last week, Chisale was transferred from Maula Prison in Lilongwe to Zomba Mental Hospital where he was expected to be examined and monitored for any signs of mental disorder.

This was after his lawyers had told the High Court that he was mentally disturbed and needed to be granted bail.

However, Judge Ivy Kamanga rebuffed Chisale, questioning how a mentally disturbed person could sign court affidavits.

Chisale has been arrested in three different scenarios on top of the murder charge. One of the cases is where it is alleged that he used his powers to cut a multi-billion kwacha cement deal with Chunara of Milton Hardware using Mutharika’s Taxpayer Identification Number.
