Sulom fails to vacate injunction
Super League of Malawi (Sulom) on Monday failed to vacate an injunction, which Dedza Young Soccer obtained on Friday, restraining the body from proceeding with play-offs.
The court was on Monday expected to rule on the case as Sulom lawyers tried to vacate the injunction that could portray a bad picture of Malawi football.
Football Association of Malawi (Fam) Article 67 discourages football entities from taking “any disputes to ordinary courts unless specifically provided for in the Fam statutes and Fifa regulations.”
The article adds that disputes must be channeled to Sulom’s legal wing, then Fam legal organs, followed by Fifa then Court of Arbitration for Sports in Switzerland.
In view of this, the stand-off has put Sulom in an awkward position a head of the new season as they are yet to identify a 16th team to join the league.
Dedza through their lawyers, Messrs Sikwese and Company, sought an injunction on Friday when the play-offs were underway at Civo Stadium, where Wizards defeated Airborne Rangers 2-1.
Sulom vice-general secretary, Thokozani Chazema, was not available yesterday as he was reportedly in court trying to vacate the injunction.
Dedza is in opposition to the play-offs, claiming they deserve to remain in the Super League based on the fact that they finished last season on position13 with 29 points.
Dedza legal adviser, William Nkhoma, yesterday said the team was still waiting for communication on the matter.
“We have not received any communication either from Sulom or Football Association of Malawi (Fam) on the issue, so far, but what surprises us is that Fam officials are commenting in the media without engaging us first for mediation on the issue at hand,” Nkhoma explained.
“We are still waiting for Fam to intervene administratively to resolve the dispute between Dedza and Sulom as provided under articles 25 and 42 of the Fam rules and regulations.”
