Transporters block IHB dissolution


The High Court sitting in Zomba has granted an injunction to 20 transporters who do not want the Natural Resources and Climate Change Committee of Parliament to proceed with its recommendations to the Ministry of Energy to dissolve fuel industry blocker, International Haulage Broker (IHB).

In a report presented to Parliament on the process of procurement of fuel by the National Oil Company of Malawi and the role of the Malawi Energy Regulatory Authority, the committee made several recommendations, including the dissolution of IHB.

But last week, a group of 20 transporters sought the intervention of the court on the matter. An interlocutory injunction obtained by the transporters restrains the committee from proceeding with its decision until a final hearing and determination of the main case.


High Court Judge Mzonde Mvula said a hearing of the interparty summons for the continuation of the injunction would be held on June 23.

“This order restrains you, the defendant [the Natural Resources and Climate Change Committee of Parliament] from implementing your resolution to have the decision challenged herein carried into effect by the Minister of Energy until the final hearing and determination of the main suit,” reads a notice to the committee.

Lawyer for the transporters, Wapona Kita, confirmed the development Monday.
