High Court Judge Mzonde Mvula has said he will give a five-day clear notice to the delivery of a bail ruling for Lester Maganga.
Maganga is accused of killing Southern Bottlers official Allan Wittika.
Mvula said this Tuesday before adjourning hearing of the alleged murder case to April 9.
“I will give five days’ clear notice to the delivery of the ruling. Ruling will be delivered anytime in the course of the trial,” Mvula said.
This means no date has been set for the ruling.
The case went back to court on Tuesday for the continuation of hearing.
However, the case did not go as planned, as the State, through Director of Public Prosecutions Masauko Chamkakala, informed the court that some of the witnesses that were supposed to be paraded did not show up.
“We were supposed to parade three witnesses today but, unfortunately, we only have one witness today. One witness cannot be traced,” Chamkakala said.
However, during examination and cross-examination, driver Paulo Mvula from Bambino Private School in Area 15, Lilongwe, told the court that he saw a person in a vehicle which is suspected to be Wittika’s.
“When I was passing by on the morning of that day, I saw a person wearing a black top and red shirt in the car; he was on the phone,” Mvula said.
But when both State and the accused person’s lawyers asked the witness if he could identify Maganga, who was standing in the dock, Mvula said he would not know.
