The Copyright Society of Malawi (Cosoma) has said it is still operating on the court order it received as regards the appointment of the board until the government resolves the issue.
“There is nothing new at the moment. We are still waiting on the government to resolve this as it [the issue] is still in their hands,” Mitungwi Chiumia said.
The Nation reported in April that the High Court had suspended the appointment of new board members for Cosoma pending a judicial review.
The decision followed a court application by Ezaius Mkandawire and Deborah Ntopa after their removal from the board.
The two were initially endorsed at an annual general meeting before being appointed as chairperson and member, respectively.

However, the government made changes, appointing a new board headed by Bishop Chimwemwe Mhango.
The two individuals were completely removed from the board.
The High Court had ordered the commencement of judicial review proceedings against the appointment of Cosoma board members and a stay order pending the determination of the judicial review.
Mkandawire said Wednesday that there was a stay order and that the ball was in government’s court.

“We are the board. I am the chairperson and that is what the law is and [what the] ruling is. It is the implementation of the same that is tricky,” he said.
When contacted to hear from the government, Ministry of Youth, Sports and Culture spokesperson Macmillan Mwale said the issue regarding the Cosoma board should be addressed to the Comptroller of Statutory Corporations.
“The Comptroller of Statutory Corporations is responsible for the appointment of boards and [is] the right authority to address the outcome from the court,” Mwale said.
The Comptroller of Statutory Corporations referred us to the Director of Communications at the Office of the President and Cabinet Focus Maganga, who was yet to respond to us as we went to press yesterday.
