Zambia national Kelby Roy Malambo, who was sentenced to 15 years imprisonment after being found with K53 million-worth of elephant ivory, has appealed the sentence.
The convict wants the sentence to be reduced to 48 months.
Malambo, who is representing himself, appeared in court yesterday and pleaded with the court to lessen his sentence.
“I am asking the court to consider reducing the number of years I was given by the subordinate court,” Malambo said.
In his submission, Malambo said the court should consider reducing his sentence to 48 months because he is a first-time offender and because, as the only breadwinner in the family, his children are suffering as they are no longer going to school.

“And, as a foreigner, it is difficult for me to get food as prisons have no food,” Malambo said.
Senior advocate in the office of the Director of Public Prosecutions Siphosaa Kajimie told the court that Malembo’s appeal should be dismissed as time for the accused to apply for an appeal has elapsed.
Meanwhile, High Court Judge Mzonde Mvula has adjourned the case to October 19, when he is expected to make his ruling.
In December 2022, Senior Resident Magistrate Wanangwa Nyirenda sentenced Malambo to 15 years imprisonment with hard labour for being found with K53 million worth of elephant ivory.

In his judgement, Nyirenda said the evidence that the State provided to the court was enough to support the sentence.
