High Court Judge Justus Kishindo has ordered that Malawi Congress Party (MCP) primary elections for Mzimba Central Constituency be held again.
This follows an application by Industry and Trade Minister Vitumbiko Mumba, who challenged the results of elections conducted on June 11, 2025.
The matter involved Mumba, who is the claimant, against MCP, as the first defendant, and Presidential Adviser on Rural Transformation Adamson Kuseri Mkandawire, as the second defendant.
In the disputed primaries, MCP declared Mkandawire the winner of the election.
In his ruling, Kishindo said MCP breached internal resolutions by adopting an illegitimate electoral college, rendering the primaries’ process flawed.

While not specifying when the polls should be conducted, Kishindo said the Mzimba Central Constituency primaries did not meet standards of fairness and democratic processes.
The court has also ordered that the new contested areas, 13 in total, should participate in the fresh primary elections.
“The new areas which have been endorsed by the constituency chairperson, the secretary and the district chairperson and were submitted to the regional chairperson, shall participate in the fresh primary elections,” reads judgement reads.
Lawyer for the claimant Khumbo Soko said justice had prevailed.

“We are happy that the court has agreed with what we were alleging. There was an allegation of violence but the court said it was not in a position to apportion any blame,” he said.
Efforts to speak to the first defendant proved futile.
But Adamson Mkandawire, who is running against Mumba, said while he accepted the ruling, he would wait for guidance from the party and remains confident that he will win in the fresh elections.
