The First Grade Magistrate Court sitting at Mkukula in Dowa District yesterday ordered the immediate release of former State House Chief of Staff Prince Kapondamgaga pending hearing of an inter-partes application for the cancellation of the said warrants, or application for determination of the legality of his arrest without warrant.
According to the amended order from the court, dated June 9, 2026, if the police want to arrest Kapondamgaga again, they should have prior authority from the courts.
Kapondamgaga was arrested on Monday in relation to the sale and purchase of Amaryllis Hotel.
“It is further ordered that if the police have acted on the suspended warrant(s) by way of arresting the applicant or if the police have arrested the applicant without a warrant issued by any other competent court, the said arrest be and is hereby nullified and it is further ordered that upon service of this order, the applicant be released from detention immediately,” the amended order reads.
Speaking in an interview yesterday evening, lawyer for Kapondamgaga, Donvan Silungwe, said they had served the order to national police headquarters at Area 30 and fiscal police at Area 6 in Lilongwe.

Silungwe added that they expected the police to release his client immediately.
“The State has the duty to comply with the court order and protect the rights of its citizens and, in this case, the rights of Mr. Kapondamgaga. Therefore, we expect that he will be released whether or not the State agrees with the order,” he said.
State lawyers were not immediately available for a comment.
