Beleaguered coach Peace Chawinga-Kaluwa has finally sued the Netball Association of Malawi (Nam) for what she termed as unlawful dismissal from the post of the Malawi National Netball Team head coach.
Through her lawyers Makiyi, Kanyenda and Associates, the former Queens centre court player on Friday dragged Nam to the Industrial Relations Court in a 15-page document seeking justice over contractual disputes.
Nam alleges that Chawinga-Kaluwa did not sign a contract extension with the national netball governing body.
Chawinga-Kaluwa’s lawyer confirmed that they filed a lawsuit on Friday last week.
“The matter is now in court,” he said.

However, Kanyenda did not disclose how much Chawinga- Kaluwa is demanding as compensation.
However, the coach has sued Nam executive committee members for unlawful termination, procedural and substantive unfairness, constitutional provisions violation, defamation, constructive dismissal, breach of contract and discrimination.
According to the court documents made available to Times Sports, Chawinga is contesting her removal as Malawi Queens head coach and seeks justice and part of the grounds read as follows:
“The conduct violated the applicants rights against section 20, 28, 29, 31 and 43 of the constitution in the international conventions. Nam violated section 5, 6 and 57 of the employment act.

“The conduct of the respondent [Nam] amounts to defamation. Conduct of the respondent amounts to breach of contract. Conduct of the respondent amounts to constructive dismissal. A declaration that the claimant [Chawinga-Kaluwa] entitled to compensation and or damages to be assessed. A declaration that the respondents executive members are personally liable to pay damages or costs of compensation, among others,” the lawsuit reads.
However, Nam General Secretary Isaac Chimwala did not respond to our questionnaire or answer our calls.
Meanwhile, Malawi National Council of Sports (MNCS) Public Relations and Communications Officer Edgar Ntulumbwa referred us to council’s board chairperson Sunduzwayo Madise but his phone was unavailable at the time we called him.
Chawinga-Kaluwa is not part of the technical panel currently in camp preparing for the 2023 Netball World Cup finals to be staged in Cape Town, South Africa, from July 28 to August 6.
Currently, Nam Technical Director Sam Kanyenda is heading the coaching panel.
